Sex Crime Attorney in Rogers, AR
Former Prosecutor. 15+ Years in Northwest Arkansas Courts.
A sex crime accusation doesn’t wait for a conviction to cause damage. Job loss, strained relationships, and public reputation harm can begin the moment an allegation surfaces. When your future is on the line, the attorney you hire matters more than in almost any other type of case. I’m Cody W. Dowden, and I defend Rogers residents facing sex crime charges throughout Benton County and Northwest Arkansas.
Before representing defendants, I served as a Deputy Prosecuting Attorney. That background gives me direct knowledge of how prosecutors build sex crime cases in Arkansas courts, what evidence they prioritize, and where their arguments may be vulnerable. I’ve been selected to Super Lawyers in 2024 and 2025, and I’ve practiced in Northwest Arkansas for over 15 years. When you hire me, you work with me directly from the first call forward, not a paralegal or another attorney.
Facing a sex crime charge in Rogers is serious, and time matters. The sooner you have a defense attorney involved, the more options you may have. Call Cody W. Dowden, Attorney at Law today at (479) 777-0640 for a free, confidential consultation with no obligation to hire.
Sex Crime Charges I Defend in Rogers
Sex crime charges in Arkansas span a wide range of offenses, carrying penalties that vary significantly depending on the alleged conduct and circumstances. Felony charges originating in Rogers are prosecuted at Benton County Circuit Court in Bentonville. Misdemeanor charges are handled locally, but a conviction at any level can carry lasting consequences.
Charges I defend include:
- Rape and sexual assault (first, second, and third degree)
- Statutory rape under Arkansas law
- Child molestation
- Child pornography possession and distribution
- Internet sex crimes and solicitation of a minor online
- Indecent exposure
- Prostitution-related offenses
Statutory rape in Arkansas involving a victim 13 or younger and an offender more than three years older is charged as a Class Y felony, the most serious classification under Arkansas law, carrying a minimum sentence of 25 years. Internet and online sex crimes are increasingly prosecuted at both the state and federal level. Even charges that appear less severe can still trigger mandatory sex offender registration upon conviction.
What Arkansas Sex Offender Registration Means for You
Under Arkansas law, a sex crime conviction triggers mandatory registration with local law enforcement. Each registrant is assessed and assigned a risk level from 1 through 4, administered by the Arkansas Crime Information Center (ACIC). That classification determines the scope of what follows.
Level 3 & Level 4 Consequences
Level 3 and Level 4 offenders face active community notification, which can include mailed flyers to neighbors, door-to-door visits by law enforcement, and direct notifications to community members where the offender lives, travels, and works. They also can’t knowingly reside within 2,000 feet of a school, public park, youth center, or daycare facility. These restrictions can take effect upon release and can reshape where you live and work for years to come.
Additional Legal Consequences
Failing to register, failing to report an address change, or missing an assessment requirement is itself a Class C felony under Ark. Code § 12-12-904, punishable by 3 to 10 years in prison and fines up to $10,000. A conviction can also affect housing applications, employment background checks, immigration status, and parental rights. Sealing or expunging a conviction doesn’t automatically end registration obligations in Arkansas; a separate court petition is required. Some registrants may apply for termination of the requirement after 15 years, subject to statutory eligibility and court approval.
The reach of these consequences is why a sex crime charge in Rogers should be defended aggressively from day one.

"After reading a multitude of positive reviews I decided to call Cody...I'm thankful I did!"
My family and I were visiting Arkansas from Texas when I was pulled over for speeding. The ticket said "15 over limit", which in Arkansas equates to an automatic "reckless driving" charge (maximum $500 fine and up to 90 days in jail). Upon learning this I panicked and immediately began looking for competent representation via the internet. After reading a multitude of positive reviews I decided to call Cody...I'm thankful I did! Upon hearing my story Cody assured me everything would be okay and then immediately went into action. When all was said and done, the charge never appeared on my driving record and I paid a small fine. I was also not required to return to Arkansas for my hearing as Cody handled everything. If you ever find yourself in need of a GREAT attorney in NW Arkansas, you should definitely call Cody Dowden!- DavidMontgomery, TX -

Building Your Defense: The Next Step
Understanding the charges and consequences is the first part. The second is knowing how to fight back. My time on the prosecution side means I approach every Rogers sex crime case with a clear picture of what the state will try to prove and where that case may be challenged.
How I Approach Sex Crime Defense
Sex crime cases often rest on one person’s account against another’s, which makes investigation critical. I examine whether search and arrest warrants were validly issued, whether forensic or digital evidence was properly collected and handled, the credibility and potential motives of the alleged victim and witnesses, and whether your constitutional rights were violated during arrest or interrogation.
Early intervention matters. When I get involved before formal charges are filed, there may be opportunities to shape how a case develops before it reaches Benton County Circuit Court. Depending on the evidence and circumstances, charges may be reduced or alternative resolutions pursued. I won’t promise a specific outcome, but I can build the strongest possible defense the facts allow.
I take your case seriously, communicate clearly, and fight for you at every stage. You’ll receive a detailed action plan promptly after our first conversation, and you’ll be able to reach me directly with questions as the case moves forward.
